Electrical Workers Local Unions

Let’s face it, there are some jobs that are just naturally more dangerous than others including construction and electrical work. New York’s Labor Laws 240 and 241 specifically outline safety requirements and regulations designed to ensure worker safety on job sites but sometimes owners, general contractors, and subcontractors fail to do so, and employees can be put at risk. Even with many safety regulations in place and management actively trying to reduce the number of injuries on the job, accidents happen and can result in life-changing injuries.

If you are an electrician in New York, you may need to navigate MagnaComp, the Local 3 plan for Workers’ Compensation benefits in the state. Read below to better understand what MagnaComp is and what the process of a personal injury case on-the-job.

What is MagnaComp and how does it work?

MagnaComp is a plan in New York State that deals with benefits for Workers’ Compensation cases. This plan is also known as MagnaCare Medical Management and is what injured Local 3 electricians must go through in order to obtain medical treatment and reimbursement for lost wages. Mark Freeley, The North Shore Injury Lawyer, has represented many injured people throughout the years, including Local 3 electricians involved in job site accidents. If one of these electricians gets injured, they are required to notify and update MagnaComp regarding the details of their injury. Details to provide include affected body parts, names of doctors, the date of the injury, degree of disability, lost time from work, course of treatment, and return to work information.

What doctors take MagnaComp?

If you are covered by MagnaCare PPO, you will need to use doctors in their network for all of your medical treatment. To find a doctor that is covered, you’ll want to go to MagnaCare’s website and search “Find a Healthcare Provider”. It’s important that you go to an approved doctor every step of the way and that your surgeries, procedures, and diagnostic testing is pre-authorized by MagnaComp to ensure you are covered for all expenses.

Other important factors of MagnaComp

Since MagnaComp is designed to protect and care for you when you’re dealing with a work-related injury, it’s important that you follow their steps and procedures every step of the way. If you have medical issues, you’ll need to consult your assigned nurse or approved doctor who will help you get the treatment you need.

A claims examiner will be assigned to you in order to help you navigate the financial process and ensure you receive the compensation owed. Checks take 11 business days from the first full missed day of work for you to receive payments. You are not allowed to be on unemployment or furlough while receiving this compensation. Additionally, throughout the process of your injury, you’ll need to provide updated medical records every 90 days to your claim’s examiner.

Help beyond MagnaComp

General contractors and owners are responsible for providing a safe worksite. In many cases, you may be entitled to receive compensation above what you are getting from these plans, and it’s a good idea to reach out to an attorney like Mark Freeley to review the facts of your accident and advise you if you have the right to pursue a lawsuit against the General Contractor and building owner in addition to your MagnaComp benefits. If you or someone you know has been in an accident at work on or near Long Island, give Mark a call at 631-495-9435 for an honest conversation.
